在死刑问题上,各执一端的死刑保留论和死刑废除论都有不少道理.但经仔细辨析反思,发现双方并不是一对一错的关系,而是均有可成立的理由.这些理由相互冲突,形成了两个令我们左右为难的选择.从死刑保留论和死刑废除论都能认可的价值命题出发对两难选择进行推理评判,最终结论是:死刑需要保留,但只能用于惩罚和威慑故意致人死命的犯罪.
