Originally he was seen as competent to stand trial, now his defense who are appealing his case, are trying to show that Tomson was not mentally stable when he committed the crime and also that he does not understand why the state is seeking the death penalty against him.

Scott Panetti was accused of killing his parents in law and convicted. Scott suffered from severe mental illness for many years, Schizophrenia. He dismissed his legal counsel and represented himself at trial wearing a cow boy suit and asking irrelavent questions.
